1.1. “Customer” means the person or entity who ordered services provided by North Lakes Web Design.
1.2. “Customer Service” means the relationship between North Lakes Web Design staff and the Customer, with the purpose of assisting the Customer with a question they have asked.
1.3. “eTicket” refers to a secure electronic message sent by the Customer to North Lakes Web Design via email for assistance or for any questions they may have with any Service(s).
1.4. “Registry” refers to person(s) or entity(ies) responsible for providing registry services. These services include customer database administration, zone file publication, DNS and DNSSEC operation, marketing and policy determination in regards to a top level domain name. A Registry may outsource some, all, or none of these services. Different registries exist for different TLDs.
1.5. “Service”, “Service(s)” or “Services” means any product(s) or service(s) the Customer has signed up to use. This can include, but is not limited to, the provisioning of space on one of our servers and a connection to and from the internet for web, email hosting and/or FTP services to function at the level specified in the chosen service level, domain name registration or transfer or renewal, SSL, and VPS.
1.6. “Big Local” means Big Local Group Pty Ltd.
1.7. “North Lakes Web Design”, “Company” or “Business” means Big Local Group t/a North Lakes Web Design.
1.8. “We”, “our” or “us” refers to Big Local Group Pty Ltd t/a North Lakes Web Design (ACN 600 083 350).
1.9. “You” or “your” refers to the person or entity who ordered services provided by North Lakes Web Design.
13.2. Our staff will offer support via email only. We do not provide support via social media. Any support offered outside of email is done at the discretion of North Lakes Web Design and may be withdrawn at any time without notice.
13.3. You agree that you will not abuse, harass, threaten or harm any North Lakes Web Design staff or customer service personnel, whether verbally, physically, or in writing. Should this occur, your services may be suspended or terminated without notice.
13.4. We reserve the right to support our services only. While we may try to help with third-party scripts, applications or services, this is not guaranteed and done at our discretion.
13.5. We reserve the right to prioritise support requests and limit the time spent on any request.
13.6. Our support service is intended to provide assistance and guidance. It is not a replacement for managed services, development, system administration, or professional services.
14.1. You agree to maintain a recent copy of all content hosted with us at all times.
14.2. We perform daily backups for shared hosting and reseller services; however, we do not guarantee their availability, integrity, or that they are free from errors.
14.3. Backup restoration is provided as a courtesy. It is your responsibility to maintain current backups.
14.4. VPS services do not include backups unless explicitly stated.
14.5. North Lakes Web Design will not be held responsible for data loss, regardless of the cause.
15.1. We may modify our Terms of Service at any time, effective upon posting to our website. Continued use of our services implies agreement to the modified terms.
15.2. If you do not agree to the amended Terms of Service, you must cancel your services with us.
16.1. North Lakes Web Design shall not be liable for any indirect, incidental, special, or consequential damages, loss of profits or business opportunities, even if advised of the possibility of such damages.
16.2. North Lakes Web Design is not liable for any damage, loss or liability resulting from any unauthorised access to or use of our services.
16.3. In any case, our total liability shall not exceed the amount paid by you for the services during the 12-month period prior to the event giving rise to the claim.
16.4. We make no warranties or representations regarding the availability, reliability or timeliness of our services.
17.1. This agreement shall be governed by the laws of the State of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts located within Queensland, Australia.
18.1. This agreement constitutes the entire understanding between North Lakes Web Design and you with respect to the subject matter hereof and supersedes all prior agreements, discussions, or understandings.
19.1. If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
20.1. The failure of North Lakes Web Design to exercise or enforce any right or provision shall not constitute a waiver of such right or provision.
